Raipur: The Supreme Court has upheld the operational style and rule-based tender process of the Chhattisgarh Medical Services Corporation (CGMSC). The Court set aside a Chhattisgarh High Court verdict that had imposed a fine (penalty) of ₹1 lakh on the CGMSC. This ruling confirms that the company’s tender process was entirely transparent and compliant with regulations. The matter stemmed from a complaint filed in the High Court by a contractor regarding a tender, which had led the High Court to impose the ₹1 lakh fine on the CGMSC.
The CGMSC challenged this decision in the Supreme Court. During the hearing, the Supreme Court found no fault on the part of the Corporation. The Court observed that all necessary information and messages had been sent in a timely manner to the official email ID provided by the contractor in the form. Since the contractor failed to respond within the stipulated timeframe, their exclusion from the tender process was carried out in accordance with the rules.
The Supreme Court concluded that the CGMSC had acted correctly throughout the matter and that the imposition of the ₹1 lakh fine was unjustified. This verdict establishes that the CGMSC adheres to strict integrity and regulatory compliance in all its tenders and procurement activities. The Corporation has stated that it will continue to work with the same level of integrity to improve healthcare facilities in the state.
