Muslim Backlash: Why Are Organizations Up in Arms Against UCC? Discover the Controversial Reasons Now!

Uniform Civil Code (UCC): As the excitement regarding UCC is increasing, various Muslim organizations have criticized this proposal. Muslim organizations have considered this a violation of minority rights. However, every organization is resorting to different arguments to oppose UCC.

The issue of Uniform Civil Code (UCC) has once again become heated in the country. The BJP government of Uttarakhand wants to implement it in its state. Taking the first step in this matter, he has introduced the bill related to UCC. If everything goes well then this bill will become a law in Uttarakhand.

The BJP led central government has also expressed its intentions regarding this. Last year, the Law Commission had asked various parties to give their opinion on UCC within 30 days. If UCC is implemented in Uttarakhand, then many BJP ruled states can implement it.

According to Shariat, Muslims can do multiple marriages, but according to the UCC bill introduced in Uttarakhand, Muslims will not be able to do more than one marriage without divorce. There will be same law for divorce for everyone. According to Shariat, the marriageable age of a girl is considered to be the beginning of menstruation. But in UCC the marriage age of a girl is 18 years. Till now any Muslim person could adopt a child, but changes have been made in the UCC regarding this also. The position regarding divorce has been clarified in the UCC bill. Both husband and wife have been given equal rights for divorce. After the implementation of this law, practices like triple talaq, halala and iddat among Muslims will be completely banned.

Muslim organizations criticized 

According to a report by The Quint, as the excitement regarding UCC is increasing, various Muslim organizations have criticized this proposal. Muslim organizations have considered this a violation of minority rights. However, every organization is resorting to different arguments to oppose UCC. Prime Minister Narendra Modi gave fresh air to it by raising the issue of UCC in his speech at a rally recently. He asked, “How can there be different laws for different people in our country?”

Said- harm to Hindu-Muslim unity 

The Law Commission had invited the opinions of political parties as well as religious and social groups regarding the implementation of UCC in a press release last month, which had created a storm. The All India Personal Law Board (IAMPLB) has argued that the UCC would violate several articles of the Indian Constitution. Jamiat Ulema-e-Hind (JIH) has said that UCC will harm Hindu-Muslim unity. Muslim relations in the country and Muslim organizations in Kerala have raised questions about the political bias behind this move. Jamiat Ulema-e-Hind (JIH), which has been vocal against the UCC in the past, seems unwilling to take a clear stand on the issue so far.

AIMPLB expressed its opinion 

AIMPLB had conveyed its opinion to the Law Commission last year. Initially, AIMPLB described the Law Commission’s notice as ‘vague and very general’. AIMPLB had said that the conditions for inviting suggestions were missing. It seems that such a big issue has been brought into the public domain for a referendum and whether the reaction of the general public also reaches the Commission in equally vague words or yes or no. Apart from Article 25 (right to freely profess, practice and propagate religion) and Article 26 (right to manage one’s own affairs in matters of religion), the AIMPLB also said it would violate Article 29 (right to protect the interests of minorities) Is also against the security of). 

‘UCC is wrong… but do not take to the streets’ 

Meanwhile, Jamiat Ulema-e-Hind (JIH) President Arshad Madani has said that UCC is against Muslim personal law. Arshad Madani said, “This is being done to create differences between Hindus and Muslims. They want to give the message that we are capable of doing for Muslims what no government has been able to do since independence.”

He said, “Muslims should not take to the streets to protest against this.” Madani also cited the previous Law Commission report, which had clearly rejected UCC as neither necessary nor desirable at this stage. In contrast, JIH has maintained relative silence on the issue. 2018 report welcomed Nor is it desirable.“However, we are not in favor of any changes and reforms in personal law suggested by the panel.”

Sources said the organization wants to wait before moving forward on the issue, as no blueprint or draft has been proposed yet. Moreover, given that many tribal organizations have also refused to accept the UCC in any form. Muslim organizations are hopeful that this may also help in derailing the proposal.

Political parties also oppose 

Meanwhile, political parties have also started their opposition to the UCC by adopting a more political line of attack. He has raised the question, what about the ‘Hindu Undivided Family’ Act?” Attacking PM Modi on this, AIMIM’s Asaduddin Owaisi wrote, “Will the PM abolish the “Hindu Undivided Family”?

Tone of protest in Kerala too 

According to The Print In Kerala, the Indian Union Muslim League (IUML) recently led a meeting of various non-political Muslim groups to express its views on the UCC. Muslim bodies attending the meeting included All Kerala Jamiathul Ulama, Kerala Nadavathul Mujahideen, Muslim Education Society and Muslim Service Society. IUML state president Panakkad Syed Sadiq Ali Shihab Thangal said, “UCC is not an issue of Muslims, it is an issue of all people. We will unite all people against this and fight legally and politically.”
