Supreme Court said- Bulldozer cannot be run at the House of the accused; Rahul praised SC’s Comment, said- BJP Exposed on Bulldozer Policy

The Supreme Court ruled against demolishing accused individuals' homes using bulldozers. Rahul Gandhi praised the decision, criticizing BJP's bulldozer policy, emphasizing that the country should be governed by the Constitution, not authoritarian power.

Supreme Court on Bulldozer Policy: On Monday, the Supreme Court heard the case of bulldozer action against the accused across the country. The Supreme Court said that if someone is only an accused, then how can action be taken to demolish the property? The bench of Justice Vishwanathan and Justice BR Gavai said, “Even if someone is guilty, such action cannot be taken.”

The Supreme Court’s comment on the bulldozer action. The court said – the house of the accused cannot be demolished, even if he is guilty.

Who has filed the petition: This petition has been filed in the Supreme Court by Jamiat-Ulema-e-Hind. It has been alleged that Muslims are being targeted in BJP ruled states and bulldozer action is being taken. Now the hearing of this case will be held on 17 September.

Leader of Opposition in Lok Sabha Rahul Gandhi praised the Supreme Court’s remarks in the bulldozer action case. He said that the anti-constitutional face of the BJP, which crushed humanity and justice under the bulldozer, has been exposed.

On social media platform X, Rahul said that we hope that the court will issue directions in this matter and protect the public from the anti-democracy campaign of the BJP governments. The country will run by Baba Saheb’s constitution, not by the whip of power.

In fact, on Monday, the Supreme Court heard the bulldozer action against the accused across the country. Allegations in the petition- Victims were not given a chance to escape

Jamiat’s lawyer Farooq Rashid said that in order to harass and intimidate minorities, state governments are encouraging bulldozer action on homes and properties.

The petition also alleges that the governments did not give the victims a chance to defend themselves. Instead, without waiting for the legal process, the victims’ houses were bulldozed as punishment.

Three states where bulldozer action took place in the last 3 months

August 2024: Action on the mansion of the accused of pelting stones on the police in Chhatarpur, Madhya Pradesh. Within 24 hours of stone pelting on the Kotwali police station in Chhatarpur, Madhya Pradesh on August 21, the government demolished the three-storey mansion worth Rs 20 crore built in 20 thousand square feet. Even when his mansion was being demolished, no member of his family was present here. According to the FIR, the four brothers had instigated the mob to attack the police.

August 2024: Bulldozers run on the house of the accused after a stabbing incident between two children in Udaipur, Rajasthan. A child studying in class 10 in a government school in Udaipur stabbed another and injured him. After this, there were arson and violent protests in the entire city. On August 17, bulldozer action was taken on the house of the accused student. Earlier, on the instructions of the government, the Forest Department had given a notice to the accused’s father Salim Sheikh to vacate the house built in an illegal colony.

June 2024: 6 properties of 2 accused were demolished in Moradabad and Ballia of Uttar Pradesh. In Moradabad, a bulldozer was run on the house of the person who tried to kidnap a married woman. The accused shot the parents and brother of the woman who opposed the kidnapping. At the same time, the hotel of hotel owner Zeeshan, who beat a young man to death in a dispute over roti in Bareilly, was razed to the ground. Sunny’s birthday was on June 26. Sunny had ordered 150 rotis from Mashal Hotel owner Zeeshan. Zeeshan gave only 50 rotis and refused to give 100 rotis. When the dispute escalated, Zeeshan along with his companions beat Sunny to death.
