UCC In Uttarakhand: The committee constituted by the Uttarakhand government to prepare the draft of the Uniform Civil Code (UCC) handed over the draft documents to Chief Minister Pushkar Singh Dhami here on Friday. In a program organized, the chairperson of the five-member committee and former Supreme Court judge Justice Ranjana Prakash Desai handed over the draft of UCC to Chief Minister Dhami. State Chief Secretary Radha Raturi was present in the program.
During this, apart from Justice Desai (retired), Justice Pramod Kohli (retired), social worker Manu Gaur, former Chief Secretary of Uttarakhand Shatrughan Singh and Vice Chancellor of Doon University Surekha Dangwal were also present.
A four-day special session of the Uttarakhand Assembly has been called from February 5 to pass the bill on UCC. The draft will also be discussed in the state cabinet before presenting it as a bill in the Assembly.
In this regard, Uttarakhand CM Pushkar Singh Dhami said that the Uniform Civil Code bill will be introduced in the upcoming assembly session and will be implemented as a law very soon. We have always been determined to provide equal rights to everyone in the state by realizing Prime Minister Narendra Modi’s vision of “Ek Bharat – Shrestha Bharat” and today we are taking this resolution towards fulfillment through UCC.
CM Dhami held a press conference on UCC –
CM Dhami held a press conference regarding UCC in which he said that the committee that made UCC has given us the draft today, the committee had first started dialogue with the villages, dialogue at 43 places in the state. The committee did it, many scholars have worked in the committee, the draft has been received in 740 pages and 4 volumes. He said that we will discuss this in the special session which is going to be held on 5th February. We will discuss in the House, this was our election resolution, we will come to power and implement it.
What will happen if UCC in Uttarakhand?
If UCC is implemented in Uttarakhand, the marriage age of girls will increase. The age of girls will now be increased from 18 to 21 years. Both husband and wife will have equal rights for divorce. Registration will be necessary after marriage. There will be a complete ban on polygamy. If anyone does, action will be taken against him. Both son and daughter will get equal rights in inheritance.
According to sources, UCC report may have these rules-
– In the report of the committee, the age for boys was fixed at 21 years and for girls at 18 years
– Men and women were given equal rights to divorce
– There will be no condition for a woman to remarry
– After the implementation of the law, it will be like Halala. When the case came to light, three years imprisonment and a fine of one lakh
– Second marriage was managed if the husband and wife were alive
– Registration of not only the marriage but also the divorce was made mandatory
– In case of divorce or domestic dispute between the husband and wife, up to five years. The mother will get the custody of the child
– Equal rights in property for all classes of sons and daughters
– Equal rights in property rights for legitimate and illegitimate children
– The child in the womb of a woman is also given protection in property rights
– Live-in registration will be mandatory on the registered web portal
– You will get a receipt on registration, you can get a house on rent without the receipt
– The registrar will inform the parents of the couple registering
– Six months’ imprisonment for not registering. Or 25 thousand fine
– No law has been made for adoption in UCC – The
marriage age of girls will be increased so that they can graduate before marriage.
-There will be mandatory registration of marriage. Without registration, you will not get the benefit of any government facility. There will be facility for marriage registration at village level also.
-Equal grounds for divorce will be available to both husband and wife. The same ground of divorce which is applicable for the husband will also be applicable for the wife. At present, under personal law, husband and wife have different grounds for divorce.
-Polygamy or polygamy will be banned.
-Girls will get equal share in inheritance as boys. Till now, according to personal law, the share of the boy is more than that of the girl.
-The responsibility of maintenance of elderly parents is also included in the compensation given to the wife on the death of her employed son. If the wife remarries, her parents will also have a share in the compensation received on the husband’s death.
– Maintenance – If the wife dies and her parents have no support, then the responsibility of their maintenance rests on the husband.
– Adoption- -Everyone will get the right of adoption. Muslim women will also get the right to adopt, the process of adoption will be made easier.
-There will be a ban on Halala and Iddat.
-Declaration of live in relationship will be necessary. This will be like a self-declaration which will have a statutory format.
– Guardianship- In case the child is orphaned, the process of guardianship will be simplified.
-In case of quarrel between husband and wife, the custody of children can be given to their grandparents.
-Population control has not been included yet.
