Samay Raina FIR Quashed by Court: The Supreme Court of India on Friday quashed all criminal proceedings registered against five comedians, including stand-up comedian and YouTuber Samay Raina. The legal dispute stemmed from allegedly offensive and insensitive remarks made regarding persons with disabilities during their popular show, ‘India’s Got Latent’. A bench comprising Justices Surya Kant, Joymalya Bagchi, and V. Mohanan heard the matter and fully exonerated Samay Raina, as well as Vipul Goyal, Balraj Paramjit Singh Ghai, Sonali Thakker, and Nishant Jagdish Tanwar, from the criminal case. The court not only granted relief to these young artists but also openly appreciated the positive efforts and fundraising events they had undertaken for the welfare of persons with disabilities.
Stance of the Supreme Court
During the hearing, the apex court expressed satisfaction with the corrective measures taken by the five comedians in recent times. The bench remarked that they are all highly promising and talented young individuals. When intentions are pure and efforts are sincere, the outcomes are invariably positive. The court acknowledged that when young people move in the right and constructive direction, society reaps better results. The Supreme Court clarified that the criminal proceedings against the comedians were being brought to a close. However, the court also clarified that broader legal issues concerning online content on digital platforms, regulatory boundaries, and the protection of the rights of persons with disabilities would remain open for judicial consideration. The court will continue the process of formulating guidelines for online content based on suggestions from the disability community.
What was the controversy, and why was the FIR filed?
The entire controversy arose following the broadcast of an episode of ‘India’s Got Latent’, which had been filmed at Khar Habitat in Mumbai on November 14, 2024. Comments made on the show regarding the treatment and costs associated with Spinal Muscular Atrophy—a severe and rare disease—were deemed derogatory to the dignity of persons with disabilities. It was alleged that individuals suffering from the condition were mocked during the broadcast. In protest, a non-governmental organization (NGO) named the ‘Cure SMA India Foundation’ approached the apex court, alleging that such statements violated the constitutional and human rights of persons with disabilities. Based on this petition, legal action was initiated against several artists associated with the show. Notably, while the Supreme Court granted interim protection from arrest to another popular YouTuber associated with the show, Ranveer Allahbadia, his main petition seeking relief remains pending before the court.
Fine, Corrective Measures, and ₹12.5 Crore in Social Service
In the initial stages of the legal proceedings, the Supreme Court expressed displeasure at the comedians’ attitude and the delay in compliance, imposing a fine of ₹3 lakh on each of them. Additionally, the court directed them to organize charity shows in honor of persons with disabilities and to utilize the proceeds for their welfare. During the latest hearing, the court was informed that the comedians had taken several significant initiatives to rectify their errors. They successfully organized a national chess tournament for differently-abled players in Pune and have scheduled four other major fundraising shows. The court was further apprised that approximately ₹12.5 crore has been raised through these events, which will be donated to support the treatment and welfare of persons with disabilities and SMA patients. Impressed by the positive dialogue between the complainant NGO and the artists, the Supreme Court expressed hope that these young individuals would continue to engage in activities promoting the welfare, rights, and dignity of persons with disabilities in the future.
