Can Mamata Banerjee Overturn the Court’s Decision on OBC Reservation? Is the BJP Targeting OBC Interests in Bengal? Mamata’s Bold Accusations and Amit Shah’s Retort Explained

Mamata Banerjee in Dumdum, West Bengal: As soon as the Calcutta High Court cancelled the OBC (Other Backward Classes) reservation given to 37 categories in West Bengal, CM Mamata Banerjee rebelled. CM Banerjee is not ready to accept the court’s decision. She has clearly said that the court’s decision to cancel the OBC status and OBC certificate is not acceptable to her. While addressing an election rally in Khardah of Dum Dum Lok Sabha constituency, Mamata Banerjee’s attitude was quite aggressive. Let us tell you that due to the decision of the Calcutta High Court, about 5 lakh OBC certificates of Muslims in Bengal will be cancelled. 

Mamata Didi hinted at challenging this order of the High Court in the apex court. Along with this, raising her voice, Mamata Banerjee said that she respects the court, but she will not accept the decision that keeps Muslims out of OBC reservation. A video of Mamata Banerjee has been shared by BJP leader Amit Malviya on his X handle, in which she is clearly seen refusing to accept the court’s order.

Mamata Banerjee’s tough stand on OBC reservation

Mamata Banerjee says that OBC reservation will continue in West Bengal, because the bill related to it was passed within the framework of the Constitution.

Mamata Banerjee said, “The government had made the bill after conducting a door-to-door survey and it was passed by the cabinet and the assembly. If necessary, she will go to the higher court against this order.”

BJP is also accused of stopping OBC reservation

CM Mamata Banerjee also blamed BJP for stopping the reservation. She said that BJP is conspiring to stop OBC reservation by using central agencies. She said, “Some people went to the court to attack the interests of OBC and filed petitions, then this incident has come to light. How can BJP show so much audacity?”. Along with this, Didi questioned BJP whether the government will be run by it or the court. Mamata Banerjee alleges that after failing in its conspiracy in Sandeshkhali, BJP is now hatching a new conspiracy.

Amit Shah’s retort on Mamta Banerjee

Meanwhile, Union Home Minister Amit Shah also attacked the Mamata Banerjee government of Bengal. On Wednesday, he accused Mamata Banerjee of compromising national security for vote bank politics and ‘committing a sin’ by allowing infiltrators to change the demography of the state. Shah even said that after BJP wins 30 Lok Sabha seats in Bengal, Trinamool Congress will disintegrate and Mamata Banerjee’s government will be ousted.

Attacking Mamata Banerjee, Amit Shah said, “Bengal has become a safe haven for infiltrators. Due to infiltration, the demography of the state is changing, which is affecting not only Bengal but the entire country.” He alleged that infiltrators are the vote bank of Trinamool Congress (TMC).

Shah said that Mamata Banerjee is opposing the Citizenship Amendment Act (CAA) to appease her vote bank. Shah even said, “TMC loves infiltrators and the attack on CAA is that infiltrators are TMC’s ‘vote bank’.”

What is the matter of cancelling OBC reservation?

The Calcutta High Court has cancelled the OBC status given to several classes in West Bengal. It has also cancelled all OBC certificates issued after 2010. The court said that such reservation in vacancies in services and posts in the state under an Act of 2012 is illegal. While passing an order on petitions challenging the provisions of the Act, the High Court clarified that if the members of the classes whose OBC status has been removed are already in service or have availed the benefit of reservation or have been successful in any selection process of the state, then their services will not be affected by this decision. 

What did the court say on OBC certificate?

This decision of the court has brought great relief to those who are working after getting reservation on the basis of OBC certificate. The High Court bench said that OBC reservation was given to some sections of Muslims for political purposes. This is an insult to democracy and the entire community. The court also said in its comment that the commission gave OBC reservation to these communities in a hurry because it was an election promise of CM Mamata Banerjee. As soon as it returned to power, the commission distributed reservation rolls in an unconstitutional manner to fulfill this promise. 

The court said in its order that within six months of the announcement of 10% reservation for backward Muslims in Bengal in 2010, the State Backward Classes Commission recommended 42 communities as OBCs, of which 41 communities were Muslims. After the recommendation, the state immediately included these communities in the list. After this, 35 classes (9 in OBC-A category and 26 in OBC-B) were included in the state on May 11, 2012. The court said that the commission gave reservation in a hurry to fulfill Mamata Banerjee’s election promise.

What will be the impact of the court’s decision?

This decision of the court is being considered a big setback for the Mamata government. The Mamata government had implemented a law in the year 2012. This law had a provision of reservation in government jobs for the OBC category. The court has also canceled a provision of that law of 2012. These included many castes and other backward classes. The court’s decision will affect about 5 lakh people. Its effect can also be seen on the vote bank of the Mamata government. According to the government’s promise, the people who were getting the benefit of reservation will not get it now, so the displeasure of these communities with the Mamata government is certain. This can affect the upcoming elections. The Mamata government may also have to face the displeasure of Muslim communities.
