The issue gained serious attention following a horrific road accident on a national highway in Phalodi a few months ago. Subsequently, in February 2026, the Rajasthan High Court directed the removal and closure of hotels, dhabas (roadside eateries), and other encroachments situated within 75 meters of all national highways in the state, in accordance with regulations. Later, in April 2026, the Supreme Court also issued an order mandating the creation of “no-construction zones,” prohibiting residential activities within 40 meters and commercial activities within 75 meters of the highways.
Ban on residential activities within 40 meters and commercial activities within 75 meters
According to the notification issued by the Revenue Department, land use conversion for residential purposes will not be permitted for any land situated within 40 meters of the national highway’s centerline (midpoint). Similarly, land use conversion for commercial purposes will remain prohibited within a 75-meter radius. This implies that residential construction may only be permitted beyond the 40-meter mark, while the 75-meter limit applies to commercial activities.
Operation of dhabas, hotels, and shops prohibited
Under the new orders, commercial activities such as dhabas, hotels, motels, restaurants, and shops will not be permitted within 75 meters of the national highway’s centerline. Furthermore, the conversion of agricultural land for commercial use will not be allowed.
Clear instructions issued to District Collectors
The Revenue Department has instructed all District Collectors not to approve any land use conversion proposals related to national highways until further orders. The department’s objective is to curb unregulated construction along highways and ensure road safety.
