Train Delay Refund: The Jharkhand Consumer Commission has delivered a significant verdict in favor of a rail passenger who endured mental, physical, and financial distress due to a prolonged train delay. In September 2024, the passenger booked two Sleeper Class tickets on the Ispat Express for a journey from Tatanagar to Sambalpur. However, the train arrived at Sambalpur with a delay of 8 hours and 48 minutes beyond its scheduled time.
Following the inconvenience caused by the long delay, the passenger sent a legal notice to the Railways and subsequently filed a complaint with the Consumer Forum. The Railways argued that the matter fell under the jurisdiction of the Railway Claims Tribunal (RCT), but the Consumer Commission rejected this contention.
The Commission’s President, Sunil Kumar Singh, and the members ruled that there was a deficiency in service on the part of the Railways. The Commission ordered the Railways to pay a total of ₹35,000—comprising ₹30,000 in compensation and ₹5,000 for litigation costs—within 45 days.
What rights do passengers have in the event of a train delay?
Under railway refund rules, passengers can cancel their tickets and obtain a refund if the train is delayed beyond its scheduled time under certain circumstances. If a train departs from its originating station with a delay of 3 hours or more and the passenger decides not to travel, there is a provision to receive a full fare refund without any cancellation charges, subject to the prescribed procedure.
If a passenger misses a connecting train due to the delay of the first train, the fare for the connecting journey may also be refunded under specific conditions. This requires adherence to applicable rules and the selection of the connecting journey option on IRCTC at the time of booking.
Additionally, for premium trains like Rajdhani, Shatabdi, and Duronto, there are provisions to provide amenities such as catering and water to passengers in the event of long delays. For certain trains like the Tejas Express, compensation provisions linked to travel insurance may also apply in cases of delay.
Filing a TDR is mandatory for a refund.
In the event of a train delay, the refund is not automatically transferred to the account. An eligible passenger is required to file a TDR (Ticket Deposit Receipt) within the prescribed rules and time limits.
How to file a TDR for an online e-ticket:
First, log in to the IRCTC website or the official app.
Go to ‘My Bookings’ and select the relevant ticket.
Click on the ‘File TDR’ option.
From the list of reasons, select the option corresponding to the train running more than 3 hours late and the decision not to travel.
Submit the TDR.
Keep in mind that adhering to the time limit for filing a TDR is mandatory in this situation.
How to get a refund for a counter ticket?
If you purchased a paper ticket from a railway station counter and the train is running 3 hours or more behind its scheduled departure time, you can claim a refund by surrendering the ticket at the counter—provided you do not undertake the journey—in accordance with the prescribed rules.
Approaching the Consumer Commission in case of significant loss
If a passenger suffers actual financial loss due to a long train delay—such as missing a flight, an important event, or an interview, or incurring other documented losses—they can approach the Consumer Commission under available legal avenues. However, a claim for compensation depends on the facts of the case and proof of the loss.
In such cases, it is crucial to preserve official records of the train delay, the ticket, travel-related documents, and proof of the financial loss.
The National Consumer Helpline (1915) can be used to lodge a complaint. Additionally, a complaint can be filed online via the Ministry of Consumer Affairs’ ‘e-Daakhil’ portal.
This matter clarifies that passengers have options beyond just a ticket refund when faced with excessive train delays. If actual and substantiated loss has occurred due to the delay, there may be a pathway to seek relief under consumer laws, depending on the circumstances.
