CG News: No escape for those involved in paper leaks or cheating! Now, it’s straight to jail; special courts to be set up in 3 cities.

Raipur: A significant step has been taken in Chhattisgarh to address cases involving cheating, paper leaks, and the use of unfair means in competitive and public examinations. The state government has issued a notification for the establishment of special fast-track courts in Raipur, Bilaspur, and Baikunthpur (in Koriya district). The objective of this decision is to expedite the judicial process in cases concerning examination-related irregularities and to ensure transparency within the examination system.

This decision was reached following consultation with the Chief Justice of the Bilaspur High Court, Krishna Ram Mahapatra. According to the Law and Legislative Affairs Department, these special courts have been constituted under Section 12-A (2) of the Public Examinations (Prevention of Unfair Means) Act, 2024. The Registrar General of the Chhattisgarh High Court, Rajneesh Srivastava, has communicated this notification to the respective District Judges.

What are the 5 major benefits of establishing these special courts?

  1. Expedited hearings for cases of cheating and paper leaks

The establishment of special fast-track courts will facilitate the rapid hearing of cases involving examination irregularities and the use of unfair means. This aims to reduce the issue of long-pending cases and accelerate the legal process.

  1. Protection of the interests of diligent candidates

Incidents such as paper leaks and cheating undermine the confidence of hardworking candidates. Ensuring timely justice in such cases will help strengthen the credibility of the examination system, thereby safeguarding the interests of those who prepare with honesty and dedication.

  1. Tighter control over cheating rackets

Accelerated judicial proceedings for examination-related offenses will expedite legal action against individuals involved in paper leaks and cheating. This will help curb organized rackets and strengthen efforts to prevent such incidents in the future. However, decisions regarding bail and sentencing will be determined by the court based on the relevant laws and the specific facts of each case. 4. Increased Confidence in Recruitment and Examination Systems

Timely resolution of cases involving irregularities in examinations can enhance the transparency of the government recruitment process. This will help strengthen the confidence of candidates in the Chhattisgarh Public Service Commission (CGPSC), Vyapam, and other recruitment examinations. However, the establishment of special courts does not, in itself, guarantee an acceleration of all recruitment processes.

  1. A Significant Step Toward Curbing Examination Malpractices

The establishment of special courts under the Public Examinations (Prevention of Unfair Means) Act, 2024, is a significant step toward making the examination system more accountable. This will provide a dedicated judicial mechanism for addressing cases related to cheating and paper leaks.

Emphasis on Ensuring a Transparent Examination System

The establishment of special fast-track courts at three locations in Chhattisgarh aims to ensure the effective resolution of cases involving the use of unfair means in public examinations. This is expected to expedite legal action against those involved in examination malpractices and help protect the interests of deserving candidates.
