Additionally, the court struck down—to that extent—the government circular and subsequent clarifications that granted actual financial benefits of the revised pension to pre-January 1, 2006 retirees only from September 1, 2008, deeming such provisions discriminatory.
This verdict was delivered by a single-judge bench comprising Justice Rakesh Mohan Pandey, following a hearing on a petition filed by Gyandatt Mishra, an 80-year-old retired Headmaster from Bastar. The court clarified that pensioners placed in similar circumstances cannot be treated differently.
Directive to Pay Arrears Within 120 Days
In its order, the High Court clarified that the governments of Chhattisgarh and Madhya Pradesh must discharge their respective financial liabilities and ensure the payment of the 32 months’ pension arrears to the petitioner within 120 days. The court further directed the state governments to comply with the order within the stipulated timeframe.
Court’s Observations on Discriminatory Provisions
During the hearing, the court observed that the arrangement granting actual financial benefits of the revised pension to pre-January 1, 2006 retirees only from September 1, 2008, created discrimination among pensioners belonging to the same category. The court held that such disparity was inconsistent with the constitutional principle of equality. Consequently, the relevant circular and clarifications were set aside to the extent of this discrimination.
