Good News for Street Vendors: Street vendors will not be arbitrarily removed during the festive season; alternative locations must be provided for them to sell their goods—directives issued to all states.

Good News for Street Vendors: Street vendors, hawkers, potters, and small traders have received significant relief during the festive season. The National Human Rights Commission (NHRC) has issued directives to all states and Union Territories, instructing them to ensure the protection of the livelihoods and human rights of local vendors during Navratri, Diwali, and Chhath Puja.

Complaints have frequently surfaced regarding the arbitrary removal, confiscation of goods, imposition of fines, and harassment of local vendors and hawkers in various cities during festivals. Last year, too, the NHRC took cognizance of such complaints and directed the concerned states and local administrations to investigate the matter and take necessary action.

Vendors Should Not Be Removed Without Cause

In view of the upcoming festivals, the Commission has once again issued necessary guidelines to states and Union Territories. The NHRC has stated that local vendors should not be removed from their spots without valid reason, nor should their livelihoods be disrupted during Navratri, Diwali, and Chhath Puja.

However, if the removal of vendors becomes necessary due to fire safety or public safety concerns, the administration must provide them with suitable alternative locations to sell their goods.

Ban on Arbitrary Confiscation of Goods

The Commission has clarified that vendors’ goods should not be confiscated arbitrarily, and any unjustified action against them must be avoided. Instructions have also been issued to take legal action regarding complaints related to harassment, extortion, or unnecessary interference.

Emphasis on Promoting ‘Vocal for Local’

The NHRC has asked local administrations to promote the spirit of ‘Vocal for Local’ during the festivals. This initiative emphasizes encouraging local vendors, traditional trades, and locally produced goods. The Commission has directed the Chief Secretaries of all States and Union Territories to convey these orders to District Magistrates, municipal bodies, the police, and other concerned officials, and to monitor their effective implementation.

The NHRC has also directed that reports regarding additional or completed actions on pending cases be submitted by October 18.
