Major ruling by Chhattisgarh HC: Husband and wife have the full right to cross-examine each other on asset affidavits.

Bilaspur: In a significant ruling regarding maintenance cases, the High Court has stated that both the husband and wife now have the full right to cross-examine each other on affidavits detailing their respective income and assets. A single bench of the High Court delivered this verdict, thereby setting aside an order by the Durg Family Court that had previously barred a husband from questioning his wife about her sources of income.

The matter stems from a maintenance application filed by a Raipur-based woman against her husband in the Durg Family Court; she had submitted an affidavit detailing her income and assets. During the proceedings on August 3, the Family Court halted the cross-examination regarding these financial details—a decision the husband subsequently challenged in the High Court.

The husband argued that this restriction prevented him from effectively presenting his case, which violated the principles of a fair hearing. Accepting his petition, the High Court directed the Durg Family Court to permit the husband to conduct the cross-examination during the hearing scheduled for September 11.
