Big relief to tenants! New rule implemented in Chhattisgarh, action will be taken against landlord if rent is increased by more than 10%

CG Rent Law: The ‘Chhattisgarh Rent Control Amendment Bill,’ introduced by Minister OP Choudhary on Wednesday during the Assembly’s monsoon session, has been passed by a voice vote. This amendment not only defines the rights of landlords and tenants but also provides a robust legal framework for the speedy resolution of disputes. This new bill is an updated version of the Chhattisgarh Rent Control Act, 2011, drafted in alignment with the Central Government’s ‘Model Tenancy Act, 2021.’ Its primary objective is to encourage landlords to rent out their vacant properties and to foster an atmosphere of trust between both parties.

b,Key Highlights of the New Rules
Regulation of Rent Hikes: If the rent for a house or shop is less than ₹2,000 per month, the maximum annual increase will be 5%. For rents exceeding this amount, the maximum annual increase allowed will be 10%.
Strict Rules on Utilities: Landlords are prohibited from disconnecting the tenant’s electricity or water supply under any circumstances. Doing so will be considered a legal offense.
Provisions for Penalties: Parties found violating the rules may face a fine exceeding ₹5,000, imprisonment of up to three months, or both.
Key Rights of Tenants
Written Agreement: Tenants have the absolute right to receive a copy of the rent agreement.
Right to Acknowledgment: Tenants have the right to demand a receipt for the security deposit, monthly rent, or any other payment made.
Habitable Accommodation: Tenants have the right to receive the premises in a habitable condition with adequate amenities before moving in.
Maintenance Facilities: Landlords are required to carry out annual maintenance. If a tenant undertakes repairs themselves, they are entitled to reimbursement, provided the cost does not exceed one month’s rent.
Key Rights of Landlords
Security Deposit: Landlords may demand a security deposit equivalent to a maximum of three months’ rent. Timely Payment: In accordance with the terms of the agreement, the landlord has the legal right to receive rent on the due date.
Right to Inspect: The landlord may inspect the property during the day in the presence of an adult male member.
Price Increase: In the event of any increase in the cost of electricity, water, or other services, the landlord may recover the additional amount from the tenant.
